Terms and Conditions of Service

§ 1 General

(1) The e-shop www.radar-warner.at (hereinafter referred to as “the E-Shop”) is operated by phase2 projekt GmbH, Grabenstrasse 41, A8712 Niklasdorf, VAT Id No.: ATU67504649, Company Register No 386371v (hereinafter referred to as „the Seller“). The Customer enters into a contract with the Seller.

(2) These Terms and Conditions, in the version which is valid at the time of order, shall apply to the processing of all orders via the E-Shop. When placing an order, the person or company placing the order (hereinafter referred to as “the Customer”), declares that he is in agreement with and accepts these Terms and Conditions.

(2) The invalidity or unenforceability of any provisions of these Terms and Conditions shall not affect the validity or enforceability of any other provision of these Terms and Conditions, which shall remain in full force and effect..

§ 2 Conclusion of the contract

The display of goods at the E-Shop does not constitute an offer in the legal sense, but rather an invitation to offer. By placing an order, the Customer submits a legally binding offer for the conclusion of a purchase agreement. The acceptance of the Customer’s order, and, thus, the conclusion of the contract take place by either by means of an order confirmation being sent within 14 days, or by dispatch of the ordered goods.

§ 3 Prices, Shipping Costs and Payment

(1) Prices are valid as displayed on the E-Shop at the time of order. Prices are valid from the date of their publication until further notice. By publishing new prices, all previously displayed prices cease to be valid.

(2) Quoted Prices include statutory VAT and do not include shipping costs.

(3) Shipping costs are paid by the Customer. Current shipping rates are displayed on the Delivery page.

(4) Payment shall be made by bank transfer or PayPal .

§ 4 Delivery

(1) Goods are normally dispatched within 2 working days after receipt of payment per courier. In case the Seller is unable to execute an order, e. g. in case of unavailability of goods, the Customer will be informed immediately.

(2) Goods will be delivered to the address provided by the Customer. In case the address provided by the Customer is wrong, incomplete or unclear, the Customer shall be responsible for any resulting expenses.

(3) Delivery of the goods to the carrier shall constitute delivery to the Customer, and all risk shall thereupon pass to the Customer.

§ 5 Retention of title

We will retain the legal title to any products delivered by us until the purchase price has been paid in full.

§ 6 Right of Return

Return Notice

(1) If you are a consumer, i. e. a natural person who purchases and item which cannot be attributed to their commercial business activity, you have the right to return received goods within 14 days of receipt without explanation by written declaration of retention or by returning the goods to the Seller. The timely dispatch of the goods or of the written declaration shall be deemed sufficient for observing the limitation period..

(2) In the event of a return, mutually received services must be returned. The Seller may claim compensation for respective value in the case of deteriorated goods and for any benefits (e.g. benefits of use) that cannot be returned either in full, partially or only in deteriorated condition. This is not applicable if the deterioration is the result of an inspection of the product, as it may have taken place in a shop. The cost of returning the goods is paid by the Customer if the delivered goods are those you ordered.

(3) The following goods are excluded from the right of return

– Goods which have been changed/adapted based on the Customer’s individual specifications

– Audio or video recordings (e.g. CDS and DVDS) or software, if the packaging seals have been broken.

§ 7 Website

(1) The texts, images, photographs and graphics (hereinafter referred to as “Contents”) on the website http://www.radar-warner.at („this Website“) are subject to copyright. Contents may be used for personal or educational purposes and must not be modified. Any other use of Contents is subject to written permission by the Seller. Any reproduction, republication, loading, announcement, diffusion or transmission is forbidden.

(2) This website offers information as well as links or references to other websites belonging to third parties. The seller does not guarantee nor does he promise the accuracy, solvency or completeness of the information presented.

(3) The seller does not guarantee the validity of the information presented on this website for all countries. Any visitor of this website visits the website at their own risk and is responsible to comply to their country’s laws.

(4) The seller has the right to change or update Contents at any time and without prior notice. Products can be removed, added or updated at any time..

(5) By entering this Website you acknowledge and agree that your use is at your own risk and that the Seller does not warrant that this website, its servers or email sent from it are free of viruses and other harmful components.

§ 8 Privacy Policy

(1) You can visit this Website without providing personal data. When visiting our website, visitor statistics such as the IP address, date and time, the browser type and the operating system that your PC currently uses, as well as the pages visited by you, will be recorded. This does not enable us to make any inferences to your personal data. Visitor statistics are used in order to improve the contents and structure of this Website.

(2) Your personal data are collected and used only when you register on the E-Shop or place an order. Thus, we only collect and use your personal information with your consent.

(3) The Customer acknowledges that the personal data collected are saved for accounting and customer recording purposes. Personal data are used in order to fulfill legal requirements and receive payment. Your personal data will not be passed on to third parties, unless this is absolutely necessary fort he fulfillment of the purchase agreement.

§ 9 Jurisdiction and applicable law

(1) All legal relationships between the Seller and the Customer shall be governed by the substantive laws of Austria, under exclusion of the UN Convention on the International Sale of Goods (Vienna Convention, CISG).

(2) Place of jurisdiction for any disputes arising from or in relation to these terms and conditions shall be the Seller’s headquarters; In the case of disputes arising from consumer contracts, place of jurisdiction shall be the Customer’s place of residence or employment.
